ViewSonic Rewards Program Terms & Conditions

 

IMPORTANT NOTICE ABOUT YOUR RIGHTS:

 

This agreement includes a mandatory binding arbitration provision and a waiver of your right to participate in a class action lawsuit. This means that most disputes between you and ViewSonic will be resolved by a neutral arbitrator, rather than in a court of law, and you will not be able to join with other customers in a class or representative action. You may, however, choose to pursue an individual claim in small claims court if it qualifies. Please read these Terms carefully, as they affect your legal rights.

 

1. Program Administration

The ViewSonic Rewards Program (hereinafter, the “Program”) is administered by ViewSonic Corporation and its affiliated entities (collectively, “ViewSonic”). These Terms and Conditions (the “Terms”) govern and control your enrollment in, participation in, and use of the Program, including but not limited to the accrual and redemption of Program rewards points (“Points”). By enrolling or participating in the Program, you acknowledge and agree to be bound by these Terms.

ViewSonic expressly reserves the right, in its sole and absolute discretion and without prior notice, to amend, modify, suspend, or terminate the Program, these Terms, and any related policies, procedures, or benefits, in whole or in part, at any time. Such modifications shall become effective immediately upon publication on the official ViewSonic website and shall be binding upon all participants.

 

2. Eligibility

The Program is open solely to natural persons who are end-user customers who:

  • Are legal residents of the fifty (50) United States or the District of Columbia;
  • Are eighteen (18) years of age or older (or the age of majority in their jurisdiction, whichever is greater); and
  • Make purchases through the U.S. ViewSonic webstore (viewsonic.com/us).

The Program is not available to individuals residing outside the United States or to non-individual entities such as corporations, resellers, educational institutions, or government organizations. However, individual educators or academic professionals who make eligible personal-use purchases directly through the U.S. ViewSonic webstore may participate in the Program, subject to these Terms. Participation is void where prohibited by law. Entities, including but not limited to corporations, partnerships, governmental bodies, resellers, distributors, educational institutions, and any other business organizations, as well as individuals purchasing for commercial, resale, or institutional purposes, are expressly excluded from eligibility unless expressly authorized in writing by ViewSonic.

  • Employees of ViewSonic Corporation, its affiliates, and its advertising or promotion agencies are not eligible to participate in the Program. This restriction also applies to immediate family members (spouse, parents, siblings, and children) and household members of such employees.

 

 

3. Enrollment & Accounts

Enrollment in the Program is gratuitous and does not require any purchase or fee. Eligible individuals may enroll directly via the ViewSonic website or, at ViewSonic’s discretion, may be automatically enrolled based upon prior qualifying transactions. Automatic enrollment shall remain subject to the ViewSonic Privacy Policy and Terms of Use.

 

Each Program membership shall be uniquely associated with a single email address. Memberships, Points, and associated benefits are strictly personal, non-assignable, and non-transferable, and may not be combined, merged, or aggregated with any other Program account or third-party rewards program.

 

 

4. Earning of Points

All Points issued under this Program are promotional in nature, have no cash value, and do not constitute property of the participant. Points are not transferable, cannot be sold or exchanged for currency, and are not redeemable for cash or cash equivalents.

 

Subject to these Terms, participants may accrue Points exclusively through qualifying activities as determined by ViewSonic in its sole discretion. Points shall have no cash value and shall not constitute property of the participant. Qualifying activities currently include:

 

  • One-time enrollment bonus of five hundred (500) Points upon initial registration;

 

  • Points awarded on eligible purchases of designated products, calculated on the pre-tax, pre-shipping purchase amount, subject to a maximum accrual of thirty thousand (30,000) Points (equivalent to three hundred U.S. Dollars (USD $300)) per calendar year;

 

  • Points awarded for each qualifying referral resulting in a new customer sign-up, limited to four hundred (400) Points per referral, with a maximum of ten (10) such referrals per account lifetime, unless otherwise specified by ViewSonic;

 

  • Points awarded for each qualifying initial order of a referred new customer, limited to four hundred (400) Points per referral, with a maximum of ten (10) such referrals per account lifetime, unless otherwise specified by ViewSonic;

 

  • Points awarded for each eligible and approved product review submission, limited to four hundred (400) Points per review, with a maximum of ten (10) such reviews per account lifetime, unless otherwise specified by ViewSonic.



    From time to time, ViewSonic may, but shall not be obligated to, offer promotional or incentive campaigns (including without limitation bonus-Point events) under conditions and timeframes it deems appropriate; however, all such activities remain subject to applicable annual and per-member limitations.---

 

5. Accrual, Activation, and Expiration of Points

Points awarded for qualifying purchases will be issued only after the order has been invoiced and shipped. If a customer returns an item, any Points earned from that purchase will be deducted from their account. If Points were used to pay for the returned item, those Points will be credited back to the customer’s account, provided they have not expired.

 

Expired Points are permanently forfeited and will not be reinstated or reissued for any reason. Participants shall have no property or residual rights in expired or forfeited Points.

 

Points shall ordinarily post to the member’s Program account within thirty (30) to thirty-five (35) calendar days following shipment, fulfillment, or validation of the qualifying activity, provided that ViewSonic shall not be responsible for delays in processing or posting. Points shall initially be reflected in a pending status and shall not be available for redemption until duly activated.

Unless otherwise stated in writing by ViewSonic, Points shall expire three hundred sixty-five (365) calendar days from the date of issuance, unless the participant has engaged in an eligible accrual or redemption transaction within such period, in which event the expiration date for all Points shall be correspondingly extended.

 

In the event of any product return, order cancellation, or refund, any Points previously awarded in connection with such transaction shall be rescinded, and ViewSonic reserves the right to deduct such Points from the member’s account, including resulting in a negative Points balance, if necessary.

 

6. Redemption & Limitations

Activated Points may be redeemed solely for rewards, credits, or benefits expressly designated by ViewSonic at the time of redemption. Points may not be redeemed for cash, are not legal tender, and possess no intrinsic monetary value. Points shall not be assigned, bartered, pledged, or otherwise transferred, whether by operation of law or otherwise.

 

Points may be redeemed toward future purchases at a ratio determined by ViewSonic, currently 100 Points = $1 in value applied at checkout. Points have no cash value and are not redeemable for currency.

 

No Points shall accrue on, nor may Points be redeemed toward, sales taxes, shipping fees, or purchases of gift cards, nor shall Points be earned on any portion of a transaction paid for with previously redeemed Points.

 

 

7. Automatic Enrollment of Existing Customers

ViewSonic may, at its discretion, automatically enroll eligible prior customers into the Program, utilizing the contact information previously provided in connection with their transactions. Such automatic enrollment shall be undertaken in accordance with applicable privacy laws and shall remain subject to ViewSonic’s Privacy Policy and Terms of Use.

 

Automatically enrolled members retain the right to opt out of the Program at any time by submitting a written request to ViewSonic’s designated customer support channel.

 

8. Promotional Activities and Member-Exclusive Events

ViewSonic may, but shall not be obligated to, conduct special promotional campaigns, exclusive sales events, or sweepstakes available only to Program members. Participation in such campaigns may be subject to additional specific terms and conditions. Unless expressly stated otherwise, such promotions shall not be combinable with any other offers, discounts, or incentives.

 

Sweepstakes or random-draw prizes shall be limited to one (1) prize per member per promotional period, as determined by ViewSonic in its sole discretion.

 

9. Termination, Suspension, and Forfeiture

ViewSonic reserves the right to suspend or terminate any membership and/or to revoke any accrued or pending Points, in the event of:

 

(i) any violation of these Terms;

(ii) actual or suspected fraudulent, abusive, or unlawful conduct; or

(iii) any misrepresentation or misuse of the Program.

Members may voluntarily cancel their participation at any time; however, upon cancellation, termination, or suspension, all unredeemed Points shall be automatically forfeited without compensation.

 

10. Modification or Discontinuance of Program

ViewSonic expressly reserves the right, in its absolute discretion, to amend, limit, modify, suspend, or discontinue the Program, its benefits, or these Terms in whole or in part, including without limitation the methods by which Points are earned, redeemed, or otherwise utilized, at any time and without liability. Notice of material changes shall be posted on the official ViewSonic website or otherwise communicated in a commercially reasonable manner.

 

11. Data Protection & Privacy

By enrolling in and participating in the Program, members expressly consent to the collection, storage, use, and processing of personal data by ViewSonic in accordance with its Privacy Policy, Terms of Use, Cookie Policy, and applicable data protection laws. Such data may include, without limitation, the member’s name, contact information, transaction history, and Points balance, and may be used for Program administration, marketing communications, analytics, and compliance purposes.

 

12. Warranty Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PROGRAM AND ALL ASSOCIATED BENEFITS, REWARDS, AND POINTS ARE PROVIDED ON AN “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS” BASIS, WITHOUT ANY EXPRESS, IMPLIED, OR STATUTORY WARRANTIES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

 

 

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER VIEWSONIC NOR ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS SHALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATING TO THE PROGRAM, EVEN IF VIEWSONIC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

 

IN NO EVENT SHALL VIEWSONIC’S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE PROGRAM EXCEED THE MONETARY VALUE OF THE POINTS ACCRUED BY THE MEMBER IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO SUCH LIABILITY.

 

14. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States of America, without regard to its conflict-of-law principles. Any disputes, claims, or controversies arising out of or in connection with the Program or these Terms shall be submitted exclusively to the competent courts located within Los Angeles County, California, United States of America, and the parties hereby irrevocably consent to the personal jurisdiction of such courts.

 

Where required by applicable law, members may have the option to resolve disputes through binding arbitration or in small claims court, as permitted under local jurisdiction.

 

MANDATORY ARBITRATION AND CLASS ACTION WAIVER:

 

To the fullest extent permitted by applicable law, any dispute, claim, or controversy arising out of or relating to the Program or these Terms shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that you may elect to pursue an individual claim in small claims court if it qualifies. You and ViewSonic expressly waive any right to a trial by jury.

 

You and ViewSonic also agree that any arbitration shall be conducted only in your individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator shall have no authority to consolidate claims or award relief to anyone other than the individual party in arbitration.

 

Arbitration shall take place in Los Angeles County, California, unless otherwise mutually agreed. The arbitrator’s decision shall be final and binding, with limited rights of appeal as permitted under the Federal Arbitration Act. The allocation of arbitration fees and costs shall be governed by the AAA Rules, except that ViewSonic will reimburse consumer filing fees for claims under USD $10,000 unless the arbitrator determines the claims are frivolous.

 

 

15. Geographic Limitations 

This Program is offered exclusively within the United States and is not available to customers located in other countries or regions. ViewSonic reserves the right to restrict, deny, or terminate participation by any individual who attempts to access or participate in the Program from outside the United States.

 

 

16. Miscellaneous

These Terms constitute the entire agreement between you and ViewSonic with respect to the Program and supersede any prior or contemporaneous agreements, communications, or understandings. No waiver of any provision shall constitute a waiver of any other provision, nor shall any waiver constitute a continuing waiver. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Section headings are for convenience only and shall not affect the interpretation of these Terms.
