Terms & Conditions
1. Overview
The ViewSonic Try & Buy Program (“Program”) allows selected business customers and partners to evaluate a ViewSonic LDS Foldable LED Display Unit (“Unit”) for a limited period prior to making a purchase decision.
This Program is strictly for business use only. By participating, the participant confirms that they are acting in a business capacity, not as a consumer. Accordingly, consumer rights and protections under applicable consumer laws do not apply to this Program.
2. Eligibility
- Participation in the Program is subject to ViewSonic’s approval.
- Only authorised partners or approved end-user customers located within the United Kingdom are eligible.
- ViewSonic reserves the right to amend, suspend, or withdraw the Program at any time without prior notice.
3. Trial Period
- The standard evaluation period (“Evaluation Period”) is up to 90 calendar days from the date of delivery.
- Any extension beyond this period must be requested in writing and approved in advance by ViewSonic.
4. Ownership
- The Unit remains the property of ViewSonic at all times until the customer has completed the purchase and full payment has been received.
- No transfer of ownership or title shall occur during the Evaluation Period.
5. Return Conditions
If the customer chooses not to purchase the Unit:
- The Unit must be returned within 14 days following the end of the Evaluation Period.
- The Unit must be returned in good condition, meaning:
- Fully functional with no operational defects
- No major cosmetic damage (e.g., cracks, dents, or deep scratches on the display or casing)
- Minor wear (e.g., light surface marks) may be acceptable if it does not affect functionality or resale value
- All original packaging, accessories, and documentation must be included
- ViewSonic reserves the right to charge a repair or refurbishment fee if the Unit is damaged or incomplete upon return.
6. Purchase Option
- At any time during the Evaluation Period, the customer may choose to purchase the Unit at the pre-agreed price.
- Upon receipt of full payment, ownership of the Unit will transfer to the customer.
7. Logistics & Costs
- Initial delivery costs are covered by ViewSonic unless otherwise stated.
- If the customer does not purchase the Unit, the return shipping cost of £400.00 will be borne by the customer.
- The customer must coordinate the return using ViewSonic’s approved logistics partner unless otherwise agreed.
8. Risk & Liability
- During the Evaluation Period, the customer assumes full responsibility for the Unit. Any loss, theft, or damage to the Unit may result in full or partial charges being applied.
- If the Unit is lost or stolen, irreparably damaged, or returned with damage that materially reduces its functionality or resale value, the customer shall be liable to pay the full or partial Manufacturer’s Suggested Retail Price (MSRP) of the Unit, as determined by ViewSonic based on the extent of the loss or damage.
- The Unit is provided solely for internal evaluation and demonstration purposes. It may be used at events, shows, or exhibitions only to promote the participant’s own business offerings.
- The Unit must not be rented, leased, loaned, or otherwise supplied to any third party for commercial hire, resale, or revenue-generating purposes.
- Any breach of this clause shall constitute a material breach of the Program Terms and may result in immediate termination of participation in the Program and/or legal action to recover damages or losses incurred.
- ViewSonic shall not be liable for any indirect, incidental, or consequential losses arising from the use or performance of the Unit during the Evaluation Period.
9. Program Inventory
- All Units provided under this Program are tracked and managed by ViewSonic.
- Returned Units may be redeployed as demonstration or B-stock Units at ViewSonic’s discretion.
- Availability of Units under the Program is limited and subject to regional inventory.
10. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of England and Wales. Any dispute arising under or in connection with this Program shall be subject to the exclusive jurisdiction of the courts of England and Wales.
