Your participation in the 4th ColorPro Awards - Global Visual Arts Competition(2023) – Social Media Lucky Draw (the “Event”) described below confirms your agreement to be bound by these terms and conditions:

All entries will be subject to Instagram’s terms of use, which can be found at www.Instagram.com. This Event is in no way sponsored, endorsed, administered by, or associated with Instagram. You understand that you are providing your information to the Administrator (Administrator: ViewSonic International Corporation, 9F, No. 192, Lien Chen Road, Zhonghe Dist., New Taipei City, Taiwan ROC.) and notInstagram.

1. PROMOTION PERIOD: The Event begins on August 15, 2023, at 12:01 AM Pacific Standard Time (PST) and ends on September 24, 2023, at 11:59:59 PM PST (“Promotion Period”). Entries received outside of this period will not be considered.
2. ELIGIBILITY: The Event is open to any individual (natural person) aged 18 years or older (the “Participant”). Employees of ViewSonic Corporation and its subsidiary companies, and each of their respective agents and immediate families are not eligible. ViewSonic assumes no liability for lost, or misdirected Entries. Each Participant is limited to entering the Promotion once using their primary Instagram account. Any Participant found to have entered more than once will be disqualified from the Event.Participant(s) may be disqualified at the Administrator’s sole discretion if he/she is determined by the Administrator to violate any aforesaid or is determined by the Administrator that any of his/her three (3) tagged Instagram friends’ accounts are owned by him/herself or that he/she violates any other term of this Terms & Conditions. All above determinations shall be at the sole and absolution discretion of the Administrator.The Administrator may request additional information or documentation to confirm eligibility and failure to provide such information within a reasonable time may result in disqualification.
3. HOW TO ENTER THE COLORPRO AWARDS SOCIAL MEDIA LUCKY DRAW: 
   Participant(s) must complete the following steps to join.
   1. Follow @colorpro on Instagram.
   2. Share the ColorPro Awards ‘Lucky Draw’ announcement post to your story.
   3. Tag three (3) friends in the comments and include the hashtag #ColorProAwards.
   Upon completing these entry steps, Participant(s) will receive an automated direct message on their main personal Instagram account confirming their entry to the Event. By entering the Lucky Draw or accepting a prize from this event, winners agree to be bound by these Terms and Conditions and to conform to all applicable laws and regulations.
4. WINNER SELECTION: After the closing date of the Promotion Period, the sole and only one (1) winner of this Event will be selected through a lucky draw from all eligible entries. The winner will be notified via Instagram direct message within 5 days after the raffle draw. The winner will have 72 hours from the time the Administrator dispatches the Instagram direct message to respond and accept the prize via email reply. If the Administrator does not receive the email reply within the 72-hour time period, the prize will be forfeited. A new winner will be chosen through another raffle draw.Once the Administrator receives confirmation from the winners with their postal address and contact details, the Administrator will endeavor to dispatch the prize within 60 days. In the event of any delay or failure in to deliver the prize due to demonstrable and unavoidable circumstances beyond the direct control of a party, and which could not have been reasonably foreseen or prevented, including but not limited to natural disasters, acts of God, actions or decisions by Foreign Governments or recognized International Regulatory Bodies, armed conflicts, adverse weather conditions, explosions, fire outbreaks, civil commotions, acts of terrorism, failures of third parties due to reasons not attributable to the party's negligence or fault, or unforeseeable industrial actions, the Administrator shall be absolved of any liability or obligation arising from the resulting delays or failure. Winners may be required to provide proof of identification and eligibility as required by the Administrator. Participant(s) must have a valid and active Instagram account to be eligible for the Event. The use of any automated system to participate in the promotion is prohibited and will result in the disqualification of any Participant attempting such use.
5. PRIZE: One (1) lucky draw winner will receive one (1) ColorPro VP2756-2K Monitor. 
   The prize is subject to availability and is non-transferable, non-refundable and no cash alternative is available (unless offered by the Administrator). The Prize may not be sold or otherwise exploited for any commercial purpose. The Prize may not be assigned, and no substitutions nor cash redemptions are available except at the Administrator’s sole discretion or as otherwise provided herein. The Administrator will not replace any lost or stolen prizes. In the event of the unavailability of the prize, the Administrator reserves the right to substitute a prize of equal or greater value. All taxes such as import tax or customs duty and gift taxes, and all other incidental expenses not specified herein will be the sole responsibility of the winner.
6. PUBLICITY: By participating in the Event, Participant(s) agree to allow the Administrator to use any content the Participant generates under the Instagram handle used to enter the Event during the Promotion Period (including comments, posts, or images) for promotional purposes related to the Event.By entering, Participant(s) will receive notification of future promotions and news from ViewSonic International Corporation. Unless prohibited by applicable law, an entry constitutes permission to use a Participant's Entry, name, photograph, likeness, voice, address (city and state), and testimonials in all media, in perpetuity, in any manner ViewSonic deems appropriate for publicity purposes without any further compensation to such Participant. The Administrator reserves all rights relating to the Administrator's social media pages, including but not limited to: i. Adding, removing, or modifying any content posted on the account. ii. Blocking users. iii. Discontinuing the account at any time.
7. DISPUTES: These terms and conditions shall be governed by and construed in accordance with the laws of Taiwan and any disputes shall be subject to the exclusive jurisdiction of the New Taipei City Court in Taiwan.
8. GENERAL: By participating, Participant(s) agree to be bound by these Terms and Conditions and the decisions of the Administrator, which shall be final in all respects. By participating in this Event and by accepting any prize that he or she may win, the Participant(s) agree to release the Promoter, the Event Administrator, Instagram, and each of their respective parent, subsidiary, and affiliated companies, units, and divisions and advertising and promotional agencies and prize suppliers; each of their respective officers, directors, agents, representatives, and employees; and each of these companies and individuals' respective successors, representatives and assigns (collectively, the ”Released Parties”) from any and all actions as described in the limitation of liability.
9. LIMITATION OF LIABILITY: The Released Parties shall not be liable for: i. Late, lost, delayed, stolen, misdirected, incomplete unreadable, inaccurate, or unintelligible entries, communications, or affidavits, regardless of the method of transmission. ii. Telephone system, telephone or computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays or transmission errors iii. Data corruption, theft, destruction, unauthorized access to or alteration of entry or other materialsiv. Any injuries, losses, or damages of any kind caused by the prize or resulting from acceptance, possession, or use of a prize, or from participation in the Event.v. Any printing, typographical, administrative, or technological errors in any materials associated with the Event.The Released Parties disclaim any liability for damage to any computer system resulting from participating in, or accessing or downloading information in connection with this Event, and the Administrator reserves the right, in their sole discretion, to cancel, modify or suspend the Event should a virus, bug, computer problem, unauthorized intervention or other causes beyond Administrator’s control that corrupts the administration, security or proper play of the Event.The Administrator may prohibit you from participating in the Event or winning a prize if, at their sole discretion, they determine you are attempting to undermine the legitimate operation of the Event by cheating, hacking, deception, or any other unfair playing practices or intending to annoy, abuse, threaten or harass any other players or Administrator representatives.
10. PRIVACY POLICY: Personal information collected during the Event will be used solely to administer the Event and contact the winner, in accordance with our privacy policy. Our privacy rights may be subject to the EU General Data Protection Regulation and by taking part in this Promotion, you agree to the terms stated in our Privacy Statement and the Terms and Conditions of Use on our website where you will find a full summary of why we need to process your personal data, what data we hold, how we use it, and your rights as a data subject.

CAUTION AND WARNING: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE EVENT MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION FROM THE EVENT. SHOULD SUCH AN ATTEMPT BE MADE, THE ADMINISTRATOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
